"David Prosser gained 7,582 votes in Waukesha County..."

"... after a major counting error of Brookfield results was detected, County Clerk Kathy Nickolaus announced in a stunning development this afternoon."

Who knows if that's the end of the back-and-forth between Prosser and Kloppenburg, but at this point it looks decisive for Prosser.

AND: Nickolaus said:
"I'm thankful that this error was caught early in the process. This is not a case of extra ballots being found. This is human error which I apologize for, which is common," Nickolaus said, her voice wavering as she spoke to reporters.
It's interesting to go back and look at Kloppenburg declaring victory yesterday:



"How do you feel comfortable declaring victory when the margin is so thin...?" Ah, yes.

ALSO: On election night, I was watching Waukesha and noted the problem:
UPDATE, 11:35: Concentrating on the AP numbers, looking at which counties still need to report, I'm irritated by the way Waukesha (strong for Prosser) and Dane (strong for Kloppenburg) seem to be holding out, like it's a game of chicken. Right now the candidates are 50-50%, with Prosser up 6,000+. It's been seesawing back and forth, with Kloppenburg up some of the time. To my eye, it looks as though there are more votes left to report in the places that are pro-Prosser, so I think in the end Prosser will squeak by.
UPDATE, 11:43: Dane (Madison's county) is nearly all in. I don't see how Kloppenburg can net more than about 3,000 with what's left of Dane. Waukesha is now shown as completely in, but the numbers didn't change, so I think something may have been misreported. I took the trouble to do a calculation and was going to predict that Prosser would net 40,000 more votes in Waukesha. What happened?

What it SHOULD say is "DISCOVERY of Waukesha County flub gives Prosser large lead".

Interesting that some of the commenters that night on this blog were surprised that Prosser didn't get as much of a bump from Waukesha County as they were expecting to see.

That's the lede but they go on to this-which is more succinct:



Nickolaus says the reason for the big change is that data transmitted from the City of Brookfield was imported but that she failed to save those results to the database.


A failure to save the data is not a failure to count the votes.

This is sort of strange, no? I mean I could understand a few hundred votes being wrong in AP's count, but that some 7,500 votes didn't get COUNTED or at least didn't get REPORTED (hard to tell which) is kinda, well, strange.

I'm not from WI, so I'll leave it up to the voters of WI if they think there should be a recount with the State picking up the tab.

I had someone on the phone long distance that is an old Cali Republican campaign worker.

He was ready to call it at 45% returns and then we both noticed the percentages in Waukesha.

We/ I tried to ask locals about the population of the county.

Everyone noticed that several Waukesha precincts were not reporting and then supposedly all 12 or 14 of them reported

without the vote total going up .

If the AP was following at closely as we were they should have noticed it.

This is the waterloo for the GOP. My feeling is that this situation is same everywhere. The GOP will narrowly win. But, in 2012, it will lose to Obama/Biden. The only way to prevent that is to have Gov. Daniels as the candidate.

I'm mostly with you on that. The problem is that people watch election results like a damned football game. They want instant gratification. And I wonder if having the counting process shrouded under a media blackout would make conspiracy theories about fraud more or less prevalent. Clearly some people (*cough* placeholder *cough*)create their own narratives about it in whatever way suits their politics, but if they'll do it either way, I'd rather keep the vote tallies sealed until they're certified.

I wonder how the AP did not notice it.

I would think that in a better world, reporters would be doing things like fact checking and seeing if the data they are getting fed is correct and showing some expertise on the subjects they report.

In today's world, though, we get the AP just passing along what they are fed, without curiosity and without credulity, as they drop by from wherever it is that they are normally stationed.

And that's without getting into whatever filters are applied due to personal biases, intentional or not.

We need a new press. Hope this internet thingy is up to the task.

Each unit is 500 previously uncounted votes for the trailing Democrat, mysteriously found in the trunk of a car after the election is over. (or something of that nature...i hadn't heard that term before and it still cracks me up)

This puts Prosser up by 15 Franken Units.

A van with 7,583 votes for Prosser's Opponent was just found in Milwaukee polling station. It was left there by a forgetful Poll worker who previously worked in King County Washington.

More car trunks are being reviewed as we speak.

I remembered reading them and thinking that people who were familiar with Waukesha Cty were finding things amiss.

That's one of the things I love about the blog - almost always someone that's in the know about the topic at hand.

I had developed a mancrush on Waukesha County given the strong conservative support they were giving. But when the votes didn't come thru like i was expecting, i must admit that I waivered in my admiration for Waukesha. Now that things have cleared up, lets just say that the mancrush is in full affect.

While I am ecstatic at this turn of events, I am wondering about all the people who are/were a bit put off by Klopsign declaring victory.

Wasn't that exactly what Prosser's campaign manager did at 2 in the morning before they essentially "signed off" and said they'd see in the morning what the total was?

I wanted to wipe the smug grimace off her face when she patted herself on the back, but people, really, they couldn't get started on the recount if there wasn't an end to the election, at which point (the end, signaling at least a premature winner), they could move on to the next step.

IMO, it's the pathetic response to the Fleebaggers in NOT passing a voter I.D. bill that could have been put in place BEFORE THIS VERY ELECTION that made this as close as it was. I am under no impression that fraud wasn't at least ATTEMPTED in this election, and THAT'S the pathetic unaddressed issue that keeps getting kicked down the road here in WI.

Well, barring fraud, no one should get *fired* for it. It happens all the time. We have this media-fed notion that "the election" is something that happens between 7pm and 11pm local time after the polls close, and the point of "the election" is to provide cinematic drama for primetime cable news.

In reality, an election is a weeks-long clerical process even when it's not close. The fact that they caught this one is a good thing, not a bad thing. Errors happen.

The process of counting votes hasn't improved much since Dewey beat Truman.

Each county counts its votes, and then submits those initial counts to the Secretary of State, usually within one or two hours after the polls close.

The AP usually relies on "stringers" ... low paid fact gatherers in each county to relay those vote totals to the AP so that the AP can "predict" a winner (they aren't predicting anything really, they're just counting the same votes turned into the Secretary of State and releasing the totals faster than the Secretary of State would.)

Often, stringers fuck up and get things wrong, or there are errors in communication.

Or, as in this case, stringers have been given an extra "incentive" by some Tea Party Patriots to make the liberal AP look like a bunch of fucking horses asses who can't count.

Nothing illegal about that - because the AP vote count isn't official.

Sure makes for some good fun, though, don't it?

Liberal or conservative, I'd like to think that someone positioned to take a seat on a state's high court would be capable of having (and willing to have) an intelligent conversation. The interviewer was absolutely correct to keep pushing her on the question of how she could be so "Nothing else to see here; I won; go home now" in a race that was, at the time, a statistical tie, well within the wiggle-error zone. She, by acting as though the question was moronic, showed herself to be moronic, or fundamentally dishonest, or both. She doesn't belong on the bench.

Mattmann, I can't imagine how unfair she would have been as a judge.

She has no capacity to follow the law. the law said there was no winner yet, for damn good reason, and she didn't care.

She wouldn't respect a legit question about this, and shows amazing intellectual dishonesty.

People must really, really hate this Prosser guy if she got as many votes as she did. Honestly, he should be ashamed of himself for that, even if he is obviously much more competent and impartial.

WI probably just dodged a huge bullet. The fact is that this Walker budget reform wouldn't have been affected by this election, but huge issues pass across a state supreme court. Someone like Klopp would have led to so many injustices, many because she is not honest, and many because she's just stupid as hell.

If Dane and Milwaukee counties certify the results that AP reported, or close enough that the differences are immaterial, the two candidates should make the following agreement:

1. Full hand recount of Waukesha County.

2. If the end result has either candidate ahead by more than 500 votes (maybe 750 or 1,000?) then the other will concede and avoid a expensive, divisive statewide recount.

That would be the "statesmanlike" thing to do. BTW, I think Kloppenburg was too quick to claim victory. But so was Prosser. He effectively did the same thing, and before she did.

I guess what everyone would like to know is, what is your opinion of what could come out of Milwaulkee?

I re-checked Milwaukee County's past voting patterns. Turnout there is always quite a bit lower than in the outlying suburbs. So I don't think their certified numbers will be very different than what they reported to the AP, but who can say?

Having grown up in Wisconsin, I'd be surprised and very disappointed if there was wholesale vote fraud there. I don't think there has been in the past. If the Waukesha numbers turn out to be fraudulent, I think it'll be like that Koss Corp. auditor who stole $32 million from the company: a one-off.

Finally, I think Waukesha's county clerk should resign. She's an incompetent bimbo who does not belong in her job, regardless of what happens now.

In any case, those are side issues. The main issue, and really the only issue, is the result. We're going to know soon enough whether Waukesha County's most recently reported numbers are accurate.

I actually think they are accurate. A little odd in the sense of the turnout being so high, but not really out of line. I think it'd be pretty hard for anyone to gin up that many fake votes in a paper-trail county.

The Waukesha County clerk is a stupid bimbo, but I really doubt she's a crazy-ass nutcase who'd fabricate these numbers. Her explanation, which boils down to a version of, "I'm too stupid to breathe," makes sense. There are plenty of idiots in government, especially local government, and she's one of them.

Hell of a way to get your 15 minutes of fame. I'm going to be surprised if Prosser winds up losing, but weirder things have happened. You just never know. But if he did win, as seems likely, the wingnuts have every right to their victory dance.

Most of the other races in my area were uncontested incumbents that i didn't like or 2-3 losers that i wouldn't vote for.

My first thought was to just vote for the supreme court race and leave the others blank. But I ended up writing in my own name in the "write-in" area.

I think the important point is the large percentage of over votes in the supreme court race, particularly in Madison where there were other important/contested races going on.

Off topic, but I've always thought it would be nice to have a "none of the above" choice for each race. Sends a general message that you're voting, but unsatisfied with the candidates.

Kloppenburg declared victory because that is what you do in close elections: you make the other guy prove he is NOT the loser. Happens all the time. So in a sense, even with Kloppenburg having a lead of just a few hundred votes, it made sense politically for her to declare victory. The public (that is not really paying attention like us...) then sees the "loser's" efforts as sour grapes, and thinks less of his/her attempts to unseat the "declared winner", no matter how legitimate the challenge may be.

Hopefully they have medics standing by at Shirley Abrahamson's home; it can't be good for her health to hear that her intern wouldn't be joining her on the Supreme Court.

I was on jury duty last week and at the jury pool orientation they showed a video that featured several clips of Abrahamson. There were a lot of audible reactions in the room whenever she appeared on screen.

This was a very clever right wing trick. They held back 7000+ votes so the lefties would underestimate how many fraudulent votes they needed in those late reporting precincts. Now the lefties have to start finding stuff in car trunks and closets all over Wisconsin.

That won't work, though. The righties have additional votes lined up and ready to go at Koch Industries. All the EvilKochBrothers have to do is press a few buttons and their direct line to Wisconsin voting machines will add any needed votes.

Oh, I agree, and as a New Yorker I had no dog in this race (but hope that Prosser wins). The problem is that all elections are political, so she tried to use a political ploy to her advantage. I am hoping it does not work out for her. If she had said she would recuse herself from the voting on any ruling involving the new "union rules" law that is likely to reach the Supreme Court, she might have won.

Forgive me if someone has already posted this speculation -- I'm joining the conversation late after a long day at work here in the Pacific time zone...

But I wouldn't be surprised if this was a planned move in a chess game. Suppose you knew the other side was waiting for results to trickle in and were holding back a few precincts where they had friendly forces to fudge the numbers they need. How can you defend yourself and yet not resort to cheating yourself? Simple: have a big block of your votes held back by "accident" (but in a way that makes them verifiable). Only play that card once the other side has done what they thought was enough. It's pure genius if that's what happened.

Of course, if that *was* what happened, we'll never know.

So Prosser's conservative, but Kloppenburg isn't necessarily liberal. Just more liberal than the conservative. Moderate, perhaps. Maybe even right of center. :)

I am extremely happy this was discovered now, and not in, say, 2 weeks, or 2 months. Imagine if that had happened. (Also, consider the reaction here at althouse had Prosser been winning by 200 and 7500 votes for Kloppenburg showed up in Dane Co!)

I do wonder how it happened. I presume that Waukesha Co will now recount everything. That seems prudent to me.

Anything where Prosser leads by more than .5% ... means the costs of a RECOUNT costs $5 "per ward." And, would be a democrat expense.

When the votes are CERTIFIED, then we will know the winnah!

Good that Prosser just waits.

He sits till August 1st, anyway.

And, so far, DRUDGE is not carrying this news.
